Kentucky House Passes Bill to Legalize Fixed-Odds Horse Racing Wagering with Breeding Industry Amendments

Kentucky’s House of Representatives passed House Bill 904, the Wagering Consumer Protection Act, which legalizes fixed-odds betting on horse racing and addresses other betting forms like fantasy contests and charitable gaming. The bill includes an amendment targeting the state’s breeding industry by limiting The Jockey Club’s authority to impose stallion book limits or deny foal registrations without unanimous international approval. It also mandates that any foal meeting registration criteria born in Kentucky cannot be denied entry and requires registrars to submit to Kentucky jurisdiction, with provisions to replace non-compliant registrars.

This amendment responds to past controversies over The Jockey Club’s proposed 140-mare cap on stallions, which was rescinded after opposition from major stud farms citing anti-competitive concerns. The bill’s wagering provisions aim to expand legal fixed-odds betting, currently allowed in only a few states, while the breeding-related changes seek to protect Kentucky’s breeding industry from restrictive stallion limits and enhance regulatory oversight. The bill now moves to the Kentucky Senate for consideration.
