The High Court of Orissa has ruled that adult women have the legal right to choose their place of residence independently, and neither parents nor in-laws can compel them to live in the parental or matrimonial home against their will. This decision came while dismissing a habeas corpus petition filed by a mother seeking to locate her married daughter, who had voluntarily left both homes and was living independently at an undisclosed location. The court emphasized that personal liberty includes the freedom to decide where to live and found no evidence of illegal detention or restraint.
The ruling reinforces the constitutional principle of personal liberty, affirming that adult women possess the same autonomy as any other adult citizen to make independent life choices free from familial coercion. Legal experts view this judgment as a significant affirmation of women’s autonomy, underscoring that the law does not permit forcing an adult woman to reside with her family if she chooses otherwise.
