Is It Illegal to Fly a Drone Over Private Property in Texas?

Drones flying over private property in Texas are generally legal under FAA regulations, provided they stay below 400 feet, avoid restricted zones, and remain within the pilot’s line of sight. However, Texas law specifically prohibits drones from recording individuals without their consent, with violations potentially resulting in misdemeanor charges and civil lawsuits allowing plaintiffs to seek damages up to $5,000 per illegally captured image.

Despite concerns about privacy, it is illegal to shoot down drones, as doing so constitutes destruction of aircraft, a federal offense.
