Gulfstream Park Sues Florida Over 2021 Decoupling Law Affecting Slot Machine Gambling Rights

Gulfstream Park has filed a lawsuit challenging the constitutionality of Florida’s 2021 decoupling law, which allows most pari-mutuel operators (except Thoroughbred racetracks) to operate slot machines without maintaining live racing. The lawsuit targets the Florida Gaming Control Commission and argues that the law unfairly singles out Gulfstream Park by requiring it to continue live Thoroughbred racing as a condition for its slot machine license, while other forms of racing or gaming were granted exemptions. Gulfstream contends this differential treatment violates its constitutional rights to equal protection and constitutes an unconstitutional special law.

The Florida Thoroughbred Breeders’ and Owners’ Association strongly opposes the lawsuit, emphasizing that Gulfstream Park’s slot machine privileges were historically tied to its commitment to Thoroughbred racing, which supports a significant agricultural economy and rural jobs. They warn that overturning the decoupling law could undermine Florida’s core horse racing industry. Gulfstream, however, argues that the law’s disparate treatment is irrational and that the legal challenge is timely, as the statute of limitations for contesting the law was about to expire. The case highlights ongoing tensions between preserving traditional horse racing and expanding casino gaming rights in Florida.
