Delhi High Court Rejects Restoration of Writ Petition After 22 Years of Unexplained Delay

The Delhi High Court dismissed an application seeking condonation of an extraordinary delay of 8,260 days (over 22 years) in restoring a writ petition originally filed in 1997 and dismissed in 2011 for non-prosecution. The petitioner, a CISF constable dismissed for unauthorized absence and negligence, failed to provide any credible explanation for abandoning the case for nearly a decade before dismissal and remaining inactive for another 14 years thereafter. The Court emphasized that such extreme negligence cannot be excused by sympathy, as it would undermine judicial discipline and encourage litigants to take courts for granted. Consequently, both the delay condonation and restoration applications were rejected.

The Court’s decision reaffirmed key legal principles: condonation of delay requires a strict showing of “sufficient cause,” which must be bona fide, unavoidable, and supported by evidence; unexplained, prolonged delays constitute laches and justify denial of relief; and courts must protect judicial efficiency by refusing to revive stale claims abandoned for decades.
