The long-running trademark dispute between international pop star Katy Perry and Australian fashion designer Katie Perry (now Katie Taylor) has finally been resolved in favor of the designer by Australia’s High Court. The conflict began when Taylor sued the singer for trademark infringement over the use of the name “Katie/Katy Perry.” Despite initial rulings against Taylor and a protracted legal battle lasting over six years, the High Court ruled that Taylor’s trademark did not breach trademark law, was unlikely to harm the singer’s reputation, and would not confuse consumers. The court agreed with Taylor’s argument that shoppers could distinguish between the two spellings and brands.
This ruling ends a David-and-Goliath legal fight that started in 2009 and saw multiple appeals, including a Federal Court decision that had threatened to cancel Taylor’s trademark. Taylor, who had been building her fashion label for nearly 20 years, celebrated the decision as a victory for small businesses and is now set to recover her legal costs from the pop star. Meanwhile, Katy Perry had initially sought to avoid involvement in the dispute but ultimately lost the case. Taylor plans to move forward with her fashion business after this lengthy legal battle.
